1. Introduction

These Terms & Conditions govern your use of the JMartin Designs website (“the Site”) and the services provided by JMartin Designs. By accessing this Site or commissioning services, you agree to these Terms in full.

2. Intellectual Property Rights

All artwork, sketches, concepts, designs, and digital files created by JMartin Designs remain the intellectual property of the Studio unless otherwise stated in writing.
Clients receive personal-use rights only, unless a separate commercial-use license is granted.

Unauthorized copying, resale, reproduction, modification, or distribution of artwork is strictly prohibited.

3. Commissioned Work & Revisions

All custom work requires a non-refundable deposit before the project begins.
Each project includes the number of revisions specified in the client’s quote or invoice.

Any additional revisions, alterations, or changes requested after approval may incur additional fees.

4. Payments & Fees

Payment terms are detailed on each invoice.
Final payment must be received before any final artwork, files, or physical products are delivered.

Accepted payment methods include Zelle, CashApp, PayPal, or other approved platforms.

5. Cancellations & Refunds

All artwork and services provided by JMartin Designs are custom. Therefore:

• Deposits are non-refundable.

• No refunds are issued for completed work.

• If a project is canceled, payment is required for all work completed up to the cancellation date.

6. Commercial Use & Licensing

Commercial usage—including album art, merchandise, marketing, resale, publishing, branding, or promotional use—requires a separate written license agreement.

Licensing fees vary depending on distribution, usage type, reach, and exclusivity.

7. Portfolio & Publicity Rights

JMartin Designs may display completed work in its portfolio, on websites, social media, exhibitions, or promotional materials.
Clients requesting confidentiality must provide written notice before the project begins.

8. Turnaround & Delivery

Estimated delivery times are provided for each project.
Timeframes may vary based on complexity, revisions, client response time, and production volume.

The Studio is not responsible for delays caused by shipping carriers or third-party vendors.

9. Website Disclaimer & Limitation of Liability

All services and information on the Site are provided “as available.”
JMartin Designs is not liable for:

• inaccuracies or omissions

• website interruptions or errors

• delays in production caused by external vendors

• damage or misuse of artwork after delivery

To the extent permitted by law, all warranties and conditions are excluded.

10. Governing Law

These Terms & Conditions are governed by the laws of the State of New York.
Any disputes arising from these Terms shall be resolved under New York jurisdiction.
